The Dormitory Authority of the State of New York (DASNY) intends to procure insurance broker services for its Directors’ & Officers’/Employment Practices Liability (D&O/EPL) insurance programs, pursuant to its discretionary purchasing authority under Public Authorities Law Section 2879. This opportunity is intended for MWBEs certified pursuant to Article 15-A of the New York State Executive Law, small businesses (a(business that is resident in this State, independently owned and operated, not dominant in its field, and employs not more than one hundred people.)(, and, if applicable, businesses selling goods or technology that are recycled or remanufactured.
DASNY intends to enter in to a contractual agreement with a broker of record who will be responsible for marketing, policy/claims administration and related services associated with DASNY’s Directors’ & Officers’/Employment Practices Liability (D&O/EPL) insurance program. The current program will expire on May 1, 2018. DASNY is interested in renewing/replacing that coverage and learning about alternative market approaches that will provide comprehensive and cost efficient insurance protection for DASNY’s exposures. See the attached Scope of Services.
Interested firms must possess: (1) substantive and successful history of brokerage expertise and experience working with clients similar in size/nature to DASNY to place and service D&O/EPL programs, (2) ability to access markets minimally rated “A-“ (A.M. Best) with capacity to bind $50M program limits, (3) ability to perform risk identification and coverage/limits/loss/pricing analyses, (4) substantive and successful D&O/EPL claims adjusting experience, (5) a valid and current Property & Casualty Insurance Broker’s license issued by the New York State Department of Financial Services, and (7) minimum Errors & Omissions Liability insurance limits of $10,000,000 or proof of insurability with a current quote for limits sufficient to reach that level.
Firms interested in responding to this solicitation must submit one (1) hard copy and two (2) CD's of their proposal to the contact noted below no later than 5:00 p.m. on Monday, December 18, 2017. Proposals received after this date will not be accepted. Proposals must include the following information in the same number order as described below:
1) Provide a cover letter with your firm’s name, address and telephone number along with the name, title, telephone number and email address of the individual within your firm who will be DASNY’s primary contact concerning this proposal.
2) Provide a description of your firm’s organization and the resumes of partners, principals, associates and other staff proposed to provide services to DASNY.
3) Provide a description of at least three (3) successful projects your firm has completed within the last five (5) years, with emphasis on placing and servicing a Directors’ & Officers’/Employment Practices Liability insurance program. Include in the description the number of employees and the general nature of the insured operations (e.g. construction, finance, manufacturing, municipality).
4) Provide a detailed description of your firm’s approach to performing the required scope of work.
5) Provide a statement indicating there are no conflicts of interest between your firm or individuals in your firm and DASNY.
6) Provide three (3) recent references with contact information and phone numbers from three (3) separate projects.
7) Provide a copy of valid and current New York State insurance license, along with evidence of Errors & Omissions insurance coverage and/or insurability.
8) Identify any previous DASNY experience providing other broker services.
9) Under separate cover, provide two (2) hard copies of a proposed fee for completing the Scope of Services, including the basis for the calculation of that fee.
NOTE:
The selected broker will be responsible for marketing DASNY’s program to insurance carriers. DASNY reserves the right to inquire as to the respondent’s preferred markets at any time during the procurement process. However, such inquiries should not be considered a promise of assignment or authorization to approach those markets, or any markets, on behalf of DASNY.
DASNY prefers to compensate insurance brokers on a fee basis, but commissions will be considered upon request. In either case, the broker will be required to disclose all sources of revenue to be earned by the broker and/or its affiliated organizations in association with the placement of the insurance programs and/or any services provided in association with those programs.
In accordance with State Finance Law § 139-j and § 139-k, this solicitation includes and imposes certain restrictions on communications between Dormitory Authority personnel and an Offerer during the procurement process. Contacts made to other Dormitory Authority personnel regarding this procurement may disqualify the Offerer and affect future procurements with governmental entities in the State of New York. All proposers, domestic and foreign, must be in compliance with New York State business registration requirements. Contact the NYS Department of State regarding compliance. In addition, business entities proposing to provide professional engineering services must obtain a Certificate of Authorization to Provide Engineering Services in New York State from the State Education Department. Proposals must be submitted in the full legal name of the proposer, or the full legal name plus a registered assumed name of the proposer, if any.
