About Freedom of Information Law (FOIL)

The Freedom of Information Law, effective January 1, 1978, reaffirms your right to know how government operates. FOIL provides rights of access to records reflective of governmental decisions and policies that affect the public. The Records Access Office hours of operations are: Monday through Friday, 8:30 a.m. to 5:00 p.m. For questions regarding access to DASNY records, please call (518) 257-3380.

The New York State Freedom of Information Law (“FOIL”), which is set forth in Article 6 of the Public Officers Law (Sections 84-90), requires that DASNY make its records available for public inspection or copying, except to the extent that records or portions thereof fall within one or more grounds for denial set for the FOIL statute.

The New York State Personal Privacy Protection Law (“PPPL”), which is set forth in Article 6-A of the Public Officers Law (§§91-99), is intended to protect your privacy by regulating the manner in which state agencies collect, maintain and disseminate personal information about you. The PPPL (i) grants you a right of access to records maintained by state agencies containing personal information about you; (ii) permits you to correct or amend information that is inaccurate or irrelevant; (iii) prohibits state agencies from collecting personal information that is irrelevant or unnecessary for their official purposes; (iv) requires that state agencies requesting personal information from you disclose why the information is being collected, how the information will be used, where the information will be maintained, and the consequences of failing to provide the requested information; and (v) protects you against disclosures of your personal information without your consent, except as specifically authorized in the law.

How to submit a FOIL request
All requests for records must be in writing and can be submitted online, mailed, emailed or faxed to the FOIL Access Administrator as set forth below. Please describe with reasonable detail the records that you are seeking. Please include relevant project information, dates, names, descriptions, time periods, etc. Also, please include your phone number and mailing address so we may contact you with any questions.

How to appeal a denial of a FOIL request
If you've been denied access by the FOIL Access Administrator, you will be notified in writing. You have a right to appeal, but you must do so within 30 days. An appeal must be filed in writing and mailed or faxed to:
