How long does it take DASNY to process a FOIL request?
By law and pursuant to DASNY Board-adopted guidelines, the Communications and Marketing Unit, acting on DASNY’s behalf, must acknowledge a FOIL request in writing within five business days of receipt. When an acknowledgement is given, it must include an approximate date, within an additional 10 business days, indicating when it is anticipated that a request will be granted or denied. If the records cannot be produced within those additional 10 business days, the Records Access Officer must advise the requestor in writing with a brief explanation for the delay and an estimate of the date when production or denial of the records will be made. Pursuant to New York State law implementing FOIL (NYCCR Title 21, Chapter LV, Part 4700.1-4700.12), if DASNY fails to acknowledge a FOIL request within five business days of receipt, a requestor may conclude that the access to records was denied and may appeal the decision.
How do I appeal a denial of a FOIL request?
Requestors have the right to appeal denials of records within 30 days after notification that a record is being withheld pursuant to applicable law or upon a failure of DASNY to acknowledge receipt of your request within five business days. Appeals should be sent to:
